I wouldn't say its DX11 support is "fake".
Perhaps it doesn't fully utilize DX11 - but it does support tessellation.

Tesselation in theory should work only with dx11 gpus, but i can run tesselation in this benchmark with my hd3850gpu which is dx10.1 only.

tessellation is supported on older cards with a DX11 wrapper. in this case the tessellation is being handled by the CPU.

No, no it's not. Tessellation is not enabled for any non-DX11 GPU even if you select DX11 mode. Have any of you even run the benchmark to test your random assertions?

Google Displacement mapping looks just like Tessellation. And I think dx 10 gpu should be able to run Tessellation Because the Xbox 360 can and its not even Dx 10 it's a customize Dx 9 from what I understand.
