EVGA threatens NGOHQ.com

Posted by Regeneration on May 2nd, 2008, 02:21 AM

It seems that EVGA is unhappy about us mirroring their EVGA Precision Overclocking Utility. They emailed us earlier in the dumb and known “If you do not immediately remove the copyrighted material from NGOHQ.com, and notify us in writing that you have done so, we will have no choice but to pursue legal action against you” fashion; instead of the wise and useful “Would you kindly” fashion.

Despite the fact Copyright and intellectual property laws vary from country to country, and our law differs from theirs, we have decided to remove it. After all - it’s their software. However, since they used a “violent” style of communications, there will be consequences: the word “EVGA” will be censored, and their hardware will be "banned" in upcoming software projects.

Note: There are millions of websites hosting drivers and software, but it seems that NGOHQ.com is the ONLY site to receive legal threats from Nvidia and their partners. Everyone is allowed to mirror these files, but only NGOHQ.com is not allowed, and we are sick of it.

The trick in this... they want more people on their website... so ... they will do alot of ads of theirs products... and the people will buy only ****(sorry censored) hardware.

thats really pathetic, instead of thanking you for providing a mirror and using your bandwidth to supply this utility to their consumers (which actually saves them money) they throw a legal threat in your face

screw EVGA, i never liked them anyways

We’re not based in the United States; we don’t have any DMCA laws. Actually, our country’s copyright law is outdated by 97 years.

Therefore, legal threats aren't only useless and dumb; it’s also insulting our intelligence. I don’t know how you’re handling things in the United States, but sending false and totally useless threats are considered "violent" here, and in most regions of the world.

Instead of sending ridiculous legal threats, you could have asked your colleagues Joe Darwin or Hans-Wolfram Tismer to contact us, and ask us “nicely” to remove the file. If they send us press releases on a weekly basis, they can also send us requests. A “would you kindly” email would benefit you more than a “useless-scary-wannabe-legal-threat”.

We removed your file, but not because of fear, but because we are developers ourselves, and we can feel your heart. After all, this is your software.

But since EVGA has decided to be “aggressive”, it just pushed us to ban the “EVGA” brand, its hardware support in our popular upcoming software projects, and even made us consider developing competitor software. I’m sure your employees are fully aware to our software and capabilities; Two years ago it was our driver that “solved” one of your product’s issues *7800 GS AGP*, when EVGA's staff members were completely helpless.

But i think evga have reason in one sence... normaly when you want to put anything you're suposed to ask to the author before (the basic of the copyrights (ANYWHERE))... and normaly they're nice and say yes because they want to spread the software

but what is the point of all of this? why are they so bent up over absolutly nothing, its not like your claiming the drivers are yours nore are you modifing them, it would be no different then providing a redirect link to their download page, this whole thing is rediculous and evga is obviously run by dingbats

eVGA is a good company as general customer service goes, but they should have asked you to kindly remove it if they so desired. They way they did it was stupid, and I don't blame you for blacklisting their products for a while. In fact, if it were me I would put it up on the front page on bold as a news article and the bi-line would read "can't we play nice?" LOL. NV is retarded anyway with their new "UMAP" policy. It's all about screwing customers $$ in the long run with obsfucation while at the same time trying to use marketing babble/lingo to say they are actually doing the opposite (eg redirect of the blame) -- but anyone with true intelligence and hardware savvy can see through it.
